The Insurance Distribution Directive comes into force on 23 February 2018, and will require some adjustment to firms’ internal procedures in any case where insurance is used as an additional support for professional risks. Whether it is defective title or contaminated land insurance in conveyancing, after the event costs insurance in litigation, or missing beneficiary policies in Probate, firms need to be aware of the new requirements. Modelled on the Insurance Mediation Directive of 2005, there are tighter controls on the links which firms can have with insurers, and the manner in which information is conveyed. Moreover, there is a requirement of 15 hours CPD per year for anyone directly involved in insurance distribution activities.

Topics covered will include:

  • The statutory background
  • The content of the IDD
  • Modifications to the SRA’s Scope and CoB Rules
  • Key requirements of “ancillary insurance distributors” such as law firms
  • Key information issues: provision, complaints, demands and needs
  • Registration with the FCA
  • Do I mention insurance at all?
